Lawyer, Personal Banking - Banking & Financial Services

Personal Banking is undergoing a period of strong expansion, and this opportunity will play a key role in ensuring that legal and regulatory risk is effectively managed across the business. 

About the role

The role is within the BFS Legal team, with key accountabilities to the various teams within the home loan, credit cards and transaction account business lines.

As a legal expert for a suite of retail lending products and services, you will liaise with a range of stakeholders across the BFS businesses and risk functions. You will work within a small team that provides prompt, high quality and commercial legal advice on an "end to end" basis across the retail lending businesses. The role reports in to the Personal Banking legal team.  The role is on a permanent and full time basis, located at 1 Shelley Street, Sydney.

Key responsibilities of this role include:

  • assisting the operations teams with issues and questions on individual mortgage lending transactions;
  • advising on product development, and enhancements to existing products and services;
  • identifying, advising on and working with the business to manage legal and regulatory risk across a range of consumer credit products and distribution models, in particular NCCP and laws and regulations governing residential mortgage lending;
  • negotiating and documenting third party and "white label" distribution agreements;
  • reviewing marketing and communication materials;
  • assisting with dispute resolution, FOS complaints and defended mortgage enforcement litigation; and
  • working closely with key business managers, operational risk and compliance teams and other members of the legal team.

About you

You will ideally:

  • be a qualified lawyer with between 3 - 5 years' PQE gained at a top tier law firm and/or in-house, at a comparable financial institution;
  • have previous experience in consumer credit, lending and third party product distribution models
  • have expertise in consumer credit industry regulation including the NCCP, Code of Banking Practice, E-Payments Code, AML, privacy, spam, Electronic Transactions Acts and credit product distribution generally;
  • be self-motivated and highly engaged at work. Enjoy working independently, yet demonstrate the flexibility to work well within teams (both legal and business);
  • possess strong interpersonal and communication (written and oral) skills; and display a professional and commercial work approach.
